Arglistige Täuschung

Vom 12.08. – 19.08.2023 haben wir (2 Erwachsene, 3 Kinder (17J, 15J, 11J) unseren Urlaub in Büsum in einem Ferienhaus (Adresse: An de Noordkant 51, D-25761 Büsum: Ferienhaus „gretas huus“) vermittelt durch die Firma Novasol verbracht. Am 19.06.2023 habe ich gebucht und 2.081 Euro überwiesen (zzgl. Gebühren für Bettwäsche, Endreinigung und Kurtaxe). Das Ferienhaus wurde in einer ruhigen Lage beschrieben und nichts deutete darauf hin, dass sich das Haus mitten auf einer Baustelle mit sehr viel Lärm und Schmutz befand. Von Mo - Fr war dann das volle Programm an Baustellenschmutz und -lärm, an Urlaub nicht zu denken. Montags und dienstags ging der Baustellenlärm bereits um 7 Uhr morgens los; teilweise waren Bauarbeiter um kurz nach 7 Uhr morgens in 2 Meter Entfernung unseres Schlafzimmers. Feierabend machten die Bauarbeiter nicht vor 17 Uhr. Aufgrund dieser Situation haben meine Frau und ich, weil wir uns belästigt gefühlt hatten, an die örtliche Polizei in Büsum am Mittwoch (16.08.) gewandt; diese bestätigte, dass unser Ferienhaus mitten in einem Neubaugebiet auf einer Baustelle befindet (sie würde dies auch bezeugen). Was den Baubeginn von 7 Uhr morgens betrifft, so haben sie uns an das örtliche Ordnungsamt verwiesen, da der Bauarbeiter erst ab 8 Uhr beginnen dürfen. Das Ordnungsamt hat sofort reagiert und war auch vor Ort mit der Folge, dass ab Donnerstag der Baustellenlärm erst ab 8 Uhr begann. Wir werden jetzt den Rechtsweg beschreiten.
